Aroi is a scan-to-order platform for Thai restaurants. A diner scans the QR code on their table, browses the menu in their preferred language, places an order, and pays via PromptPay or card. Restaurant owners and staff use Aroi to manage menus (including AI-assisted menu translation), accept orders, run the kitchen display, and view sales summaries.
1. Acceptance of Terms
By downloading, installing, or using Aroi (the “App”) provided by TM3P Tech (“we”, “us”, “our”), you agree to be bound by these Terms and Conditions (the “Terms”). If you do not agree, do not use the App.
2. Eligibility
A restaurant operator account may be opened only by a business or by someone authorized to act for a business; the account holder must be at least the age of majority in their jurisdiction. Diners may use the public scan-to-order experience without an account. Children should order with the assistance of an accompanying adult.
3. License
Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to install and use the App on a device that you own or control, solely for your personal, non-commercial use.
4. Restrictions
You agree not to: (a) reverse engineer, decompile, or disassemble the App except where permitted by applicable law; (b) interfere with or disrupt the App or any servers or networks connected to the App; (c) use the App to violate any applicable law or regulation; (d) attempt to gain unauthorized access to any portion of the App; or (e) use the App in a way that could harm us, the App, or any third party.
5. User Content
If the App allows you to submit content, you retain ownership of that content. You grant us a worldwide, non-exclusive, royalty-free license to host, store, and display your content as necessary to operate the App. You are solely responsible for the content you submit and must have the rights to share it.
6. Third-Party Services
The App may integrate or rely on services provided by third parties (such as Apple, Google, Firebase, or analytics and advertising providers). Your use of those services is governed by the respective third party’s terms and privacy policies, and we are not responsible for their practices.
7. In-App Purchases and Subscriptions
Aroi is not sold as a consumer product. Pricing, subscription, or revenue-share terms for restaurant operators are agreed separately between TM3P Tech and the restaurant. Payments accepted from diners (PromptPay, card via Omise, or 2C2P) are processed by the relevant payment provider; we do not store full card numbers ourselves.
8. Updates
We may release updates, patches, or new versions of the App. Some updates may be required for continued use. We may modify or discontinue features at any time without liability to you.
9. Intellectual Property
The App, including all software, text, graphics, logos, and other content (excluding user content), is owned by or licensed to TM3P Tech and is protected by intellectual property laws. No rights are granted to you other than the license set out in Section 3.
10. Disclaimers
THE APP IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE APP WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE.
11. Limitation of Liability
To the maximum extent permitted by law, TM3P Tech and its affiliates, officers, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, revenue, data, or use, arising out of or in connection with your use of the App.
12. Indemnification
You agree to defend, indemnify, and hold harmless TM3P Tech from any claims, damages, liabilities, costs, or expenses (including reasonable attorneys’ fees) arising out of your use of the App or your breach of these Terms.
13. Termination
We may suspend or terminate your access to the App at any time, with or without notice, for conduct that we believe violates these Terms or is otherwise harmful. You may stop using the App at any time by uninstalling it.
14. Governing Law
These Terms are governed by the laws of the Kingdom of Thailand, without regard to its conflict-of-laws principles. The exclusive venue for any dispute shall be the competent courts located in Bangkok, Thailand, except where prohibited by applicable law.
15. Changes to These Terms
We may update these Terms from time to time. Material changes will be indicated by updating the “Last updated” date. Your continued use of the App after changes take effect constitutes acceptance of the revised Terms.
